On November 6, 2025, the FDA’s Digital Health Advisory Committee convened a public meeting to explore how generative AI—especially large language models—is transforming digital mental health tools. The Committee has not yet promulgated new regulations, but the meeting clearly signaled that regulatory expectations are evolving for AI‑enabled tools in mental health care.
We share this update to help healthcare providers—especially those in resource‑limited and rural settings—understand the regulatory trajectory and what it means for safe and effective adoption of AI‑based mental‑health tools.
Why This Matters for Providers in Low‑Resource and Rural Settings
Even if your organization is not directly developing such tools, you may adopt or evaluate them. Key considerations:
- Tools marketed for “consumer wellness” may still draw regulatory attention if they cross into diagnostic or therapeutic territory.
- The FDA’s docket (FDA‑2025‑N‑2338) is open for comment until December 8, 2025 — this is a rare opportunity to help shape policy.
- Because many rural and safety‑net providers adopt digital mental health solutions to fill workforce gaps, the regulatory framework moving forward may impact evaluation, procurement, implementation, and monitoring of these tools.
